General Terms and Conditions of Use and Sale
This document governs the use of the sybatiles.ma website and the business relationship between Sybatiles and its customers.
This translation is provided for information only. In the event of any discrepancy, the French version shall prevail.
Purpose & definitions
These General Terms and Conditions of Use and Sale (hereinafter "Terms") govern the relationship between Sybatiles, a Moroccan manufacturer of handmade cement tiles and zellige (hereinafter "the Seller"), and any natural or legal person placing an order via the sybatiles.ma website or directly with the sales team (hereinafter "the Buyer").
By browsing the website, submitting a contact form or confirming an order, the Buyer acknowledges having read these Terms and accepts them without reservation.

Orders
2.1 Handmade nature of the products
Sybatiles cement tiles and zellige are made by hand by skilled craftsmen. Because of this handmade process, slight variations in colour and shade, surface halos and minor irregularities inherent in manual production may occur from one piece to another. These characteristics are part of the authentic value of the product and shall not be considered defects.
2.2 Order confirmation
Every order is confirmed by signing a purchase order stating the product references, quantities, chosen colours, delivery and billing addresses and the total amount. No order is processed until the deposit defined in Article 3 has been received.
2.3 Changes and cancellation
An order that has been confirmed and for which the deposit has been paid is firm and final. Any change or cancellation must be requested in writing and is subject to the express agreement of Sybatiles. If a cancellation is accepted, the deposit paid is retained by Sybatiles as a lump-sum compensation.
Prices & payment
3.1 Prices
Prices are expressed in euros (EUR) or Moroccan dirhams (MAD) according to the quotation, excluding applicable taxes and excluding transport, export and customs clearance costs, which are borne by the Buyer unless explicitly stated otherwise.
3.2 Payment terms
A 50% deposit of the total amount is required when the order is confirmed. The 50% balance is due before the goods are shipped. Payment may be made by international bank transfer, certified cheque or any other method agreed in writing with the Sybatiles team.
3.3 Late payment
Any late payment makes the full amount due immediately payable, increased by late-payment penalties calculated at the legal rate in force in Morocco, without prior formal notice.
Delivery
4.1 Lead times
The production and delivery times given are indicative. Sybatiles makes every effort to meet them, but a delay may under no circumstances justify cancelling the order, refusing the goods or applying penalties, unless agreed in writing beforehand.
4.2 Transfer of risk
The risk of loss of or damage to the goods passes to the Buyer as soon as they are handed over to the carrier or collected from the workshop. The Buyer is responsible for unloading, final transport and placing the products on site.
4.3 Receipt and reservations
On receipt, the Buyer must check the condition and quantity of the goods in the presence of the carrier. Any damage or shortage must be recorded as precise and detailed reservations on the delivery note and then confirmed to Sybatiles by email within 72 hours of delivery. After this period, the delivery is deemed compliant.
Right of withdrawal
In accordance with Moroccan consumer protection law (Law No. 31-08), the right of withdrawal does not apply to products made to the Buyer's personalised specifications (choice of patterns, colours, custom sizes), which make up most of the Sybatiles offer.
For orders of standard, non-customised products, a withdrawal period of 7 working days from receipt may be granted, provided the products are returned in their original packaging, unlaid, uncut and in perfect condition. Return costs are borne by the Buyer.
Returns & complaints
Any return of goods requires the prior written consent of Sybatiles. Products returned without authorisation will not be accepted. If a return is accepted, Sybatiles will offer, at its discretion, a credit note, an exchange or a partial refund, less handling and transport costs.
Complaints about an apparent defect or non-conformity must be sent by email to contact@sybatiles.ma within 72 hours of receipt, together with detailed photographs of the problem.
Important: any tile that has been laid, glued or sealed is considered accepted as is. No complaint about an apparent defect will be accepted after laying.
Retention of title
Sybatiles retains full ownership of the goods delivered until the price has been paid in full, including principal and ancillary costs. In the event of non-payment, Sybatiles reserves the right to take back the goods delivered, without prejudice to any other remedy.
The risk of loss or damage nevertheless passes on delivery, in accordance with Article 4.
Storage & installation
8.1 Storage
Tiles must be stored flat on a level surface, protected from the weather, excessive humidity and impacts. Improper storage may affect the colour or strength of the product and releases Sybatiles from all liability.
8.2 Laying
Laying must be carried out by a qualified professional. It is recommended to mix tiles from several boxes before laying in order to even out any natural variations in shade. Sybatiles cannot be held liable for laying that does not comply with good practice.
8.3 Sealing and maintenance
Cement tiles are porous materials that require sealing before and after laying with a suitable product. Day-to-day cleaning must be done with non-acidic, non-abrasive products. Prolonged exposure to aggressive agents (acid, bleach, chlorinated products) may damage the surface and voids the warranty.
Warranties
9.1 Legal warranty of conformity
Sybatiles guarantees its products against any manufacturing defect or substantial non-conformity found on receipt, under the conditions and within the time limits set out in Articles 6 and 4.3. If a defect is confirmed, Sybatiles will replace or exchange the pieces concerned.
9.2 Warranty exclusions
The following are expressly excluded from the warranty:
- Laid products
- Any tile that has been glued, sealed or laid is deemed accepted without reservation.
- Unreported apparent defects
- Visible defects not reported within 72 hours of receipt.
- Natural variations
- Differences in shade, halos and slight irregularities inherent in handmade production.
- Incorrect laying or unsuitable maintenance
- Damage resulting from non-compliant laying or aggressive cleaning products.
- Outdoor exposure
- Untreated cement tiles exposed to UV light may lose colour intensity.
Intellectual property
All content on the sybatiles.ma website — texts, photographs, visuals, patterns, logos, designs and graphic elements — is the exclusive property of Sybatiles and is protected by Moroccan intellectual property law.
Any reproduction, copying, modification or commercial use, in whole or in part, without the prior written permission of Sybatiles is strictly prohibited and constitutes infringement that may give rise to civil and criminal liability.
The tile patterns and designs are original creations of Sybatiles. Reproducing them for commercial purposes without a licence is expressly prohibited.
Force majeure
Sybatiles cannot be held liable for any delay in or failure to perform its obligations resulting from an event of force majeure within the meaning of Moroccan law, including natural disasters, armed conflict, general strikes, shortages of raw materials, restrictive government measures or any other cause beyond the control of Sybatiles that affects the normal course of its business.
In the event of force majeure, Sybatiles will inform the Buyer as soon as possible. If the impediment lasts longer than 60 days, either party may cancel the order in writing, and the deposit will be refunded less any costs already incurred.
Governing law & jurisdiction
These Terms are governed by Moroccan law, in particular the Commercial Code, Law No. 31-08 on consumer protection and Law No. 09-08 on the protection of personal data.
In the event of a dispute, the parties undertake to seek an amicable solution within 30 days of written notification of the dispute. Failing an amicable settlement, the dispute will be submitted to the exclusive jurisdiction of the Commercial Court of Marrakech.
